Please read the following terms and conditions of use carefully before using this website. All users of this site agree that access to and use of this site are subject to the following terms and conditions and other applicable law. If you do not agree to these terms and conditions, please do not use this site.

Fair Usage Policy

Instaform operates on a fair usage basis to ensure consistent service quality for all users. Specific quotas (submissions per month, file size, rate limits) are listed in the sections below. In addition, we reserve the right to enforce reasonable limits on the following, even where no specific quota is published:

• Aggregate storage and bandwidth use disproportionate to your plan
• Number of forms, link pages, contacts, deals, or other resources created when the volume far exceeds reasonable use
• Concurrent or burst traffic that degrades service for other users
• Behavior that appears designed to circumvent published quotas (for example, creating multiple accounts to multiply free-tier limits)
• Use of the Service for purposes substantially different from its intended use as a form-builder and link-page platform

If your usage triggers a fair-usage review, we will normally contact you first to discuss before applying any throttling or restriction. We may take immediate action, however, if usage poses a risk to the stability or security of the Service for other users.

Form Submissions

• Reasonable limits apply to form submissions based on your plan
• Free accounts: Up to 100 submissions per month
• Paid accounts: Based on subscription tier
• Submission rate limiting applies: 60 submissions per minute per IP address, and 100 submissions per hour per form

File Attachments

• Maximum file size: 10MB per file
• Maximum total attachments per submission: 50MB
• Supported file types: Images, PDFs, Documents, Spreadsheets

API Usage

• Rate limits: 100 requests per minute per IP address
• Bulk operations may have additional limits

Prohibited Activities

The following activities are strictly prohibited:

• Automated submission of forms without user consent (spam)
• Uploading malicious files or content
• Using the service for phishing or fraud
• Circumventing rate limits or security measures
• Harvesting user data without consent
• Sending unsolicited communications via forms
• Using the service to distribute malware or viruses
• Attempting to gain unauthorized access to other accounts or systems
• Using the service for any illegal purposes

Enforcement

We reserve the right to:

• Temporarily or permanently suspend accounts violating these terms
• Remove content that violates our policies without prior notice
• Implement additional restrictions as needed to protect service quality
• Report illegal activities to appropriate authorities
• Block IP addresses engaging in abusive behavior

Data Retention

• Active accounts: Data retained indefinitely while account is in good standing
• Inactive accounts (12+ months): Data may be archived or deleted
• Deleted accounts: Data permanently removed within 30 days
• Form submissions: Retained according to account owner's settings and subscription tier

Service Availability

• We aim for 99.9% uptime but do not guarantee it
• Scheduled maintenance will be announced in advance when possible
• Emergency maintenance may occur without notice
• No compensation is provided for service interruptions

Children Under 16

Instaform is intended for users aged 16 and over. We do not knowingly collect personal data from children under 16. If we learn that we have inadvertently collected personal data from a child under 16, we will delete it as soon as practicable. Parents or guardians who believe their child has provided personal data through Instaform should contact us at [email protected].

Copyright Infringement (DMCA)

Instaform respects intellectual property rights. If you believe content uploaded to or submitted through a form on Instaform infringes your copyright, you may submit a takedown notice to [email protected]. To be effective, your notice must include:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing material, with enough detail (URL, form ID, submission ID) to allow us to locate it
• Your contact information (name, address, phone, email)
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf
• Your physical or electronic signature

We will respond to valid notices in accordance with the U.S. Digital Millennium Copyright Act and equivalent EU law, which may include removing or disabling access to the material and notifying the user who uploaded it. Repeated infringers will have their accounts terminated.

Warranty Disclaimer

This site and the materials and products on this site are provided "as is" and without warranties of any kind, whether express or implied. To the fullest extent permissible pursuant to applicable law, Instaform disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.

Limitation of Liability

Instaform shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the services and products offered on this site, or the performance of the services and products.

Indemnification

You agree to indemnify, defend, and hold harmless Instaform (TDI d.o.o.), its officers, employees, and agents from any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service in violation of these Terms or applicable law; (b) any content you submit, upload, or transmit through the Service, including content collected via forms you create or operate; (c) your infringement of any third-party intellectual property, privacy, or publicity right; or (d) any claim by a respondent to a form you operate that you collected, processed, or shared their personal data unlawfully. This indemnification does not apply to claims arising from Instaform's gross negligence or willful misconduct, and is limited to the extent permitted by applicable mandatory consumer-protection law.

Force Majeure

Neither party will be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure results from events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, labor disputes, internet or telecommunications outages, or failures of third-party providers (including hosting, payment, and email infrastructure). The affected party will notify the other promptly and use reasonable efforts to resume performance. Obligations to pay amounts already due are not excused by force majeure.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia, without regard to its conflict-of-law principles. The courts of Rijeka, Croatia have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may bring proceedings in any jurisdiction where you are located if necessary to enforce our rights. Nothing in this section limits any mandatory consumer-protection rights you may have under the law of your country of residence; if you are a consumer in the European Union or United Kingdom, you may also bring claims in the courts of your country of residence.
